Terms of Service.
1. CONDITIONS OF THE ONLINE SHOP SERVICE:
Customer Registration
To start the purchase procedure of the products of the Website/App, the Customer must register in the section of the Website "Register" (or as a "guest") or in the section of the App "Create Account". In subsequent purchase processes, in the event that the Customer has registered, it will only be necessary to provide their email address and password in the "My Account" section.
Price and payment
The price of the products will be the one that appears in the currency indicated next to each product on the Website.
The sales prices indicated on our website are shown as follows:.
- If the Customer resides in the European Union, all prices include VAT.
- If the Customer resides outside the European Union, prices do not include VAT. However, any local taxes and/or any import duties and/or local customs duties will be charged to the Customer when the shipment arrives at its destination, if applicable.
Shipping costs are not included in the price of the products and are borne by the customer if the order does not have free shipping. These shipping costs will be added to the total amount of the selected products so that the customer can check them at any time in the shopping cart before confirming the order and finalize the purchase process.
YOUREMTB reserves the right to make, at any time and without notice, any changes it deems appropriate, and may frequently update products or prices. The price applicable to the purchase request made by the Customer will be the one that appears at the time of accepting the General Conditions of Purchase.
The Customer may pay for the products by any of the means of payment indicated below:
- Payment by card The customer must include the number of your debit / credit card (Visa, Visa Electron and Mastercard), as well as other additional information, which is required in the purchase procedure. The charge will be made once it has been accepted by the customer's financial institution, otherwise the purchase will not be completed.
When you add a new payment method during checkout, we will automatically save this information in your Account so that it can be used for future transactions. To do this, the customer authorizes YOUREMTB to manage the storage of your payment method data and to practice charges through it. The payment method data is stored by "Stripe" as a payment processor in accordance with the standards and regulations in force in the payment industry.
The customer is solely responsible for the accuracy of their payment method information and YOUREMTB is not responsible for any loss that the customer may suffer as a result of incorrect information about the payment method provided.
YOUREMTB has high security measures. Also, the payment process works on a secure server using the SSL Protocol(Secure Socket Layer). The secure server establishes a connection so that the information is transmitted encrypted using 128 bit algorithms, which ensure that it is only intelligible to the customer's device. In this way, using the SSL Protocol guarantees:
a) That the Customer is communicating your data to YOUREMTB server and not to any other.
b) That between the Client and the YOUREMTB server the data is transmitted encrypted, avoiding its possible reading or manipulation by third parties.
YOUREMTB has implemented a program to detect possible fraudulent transactions and reserves the right to request information, confirmations and / or additional documents to the Customer, even after having made one or more purchases through the Website / App, by phone call or email, in order to confirm that the Customer has actually made and authorized the purchase and / or that the delivery or return of the same has been done correctly and thus finally authorizes the respective transaction.
YOUREMTB may make various telephone checks on the identity of the Customer, or request: (a) a written confirmation and authorization signed by the Customer responsible for the respective purchase; and (b) a copy of the Customer's valid official photo ID to confirm their identity. YOUREMTB is obliged to store such information and documents with high security measures, in accordance with current regulations.
In the event that the Customer does not respond favorably or does not provide YOUREMTB with the documentation and information requested within 48 hours from the call or email sent by YOUREMTB, the transaction detailed in that communication and the respective order may be canceled without further notice or liability of YOUREMTB, proceeding to refund the Customer the amount paid in respect of the purchase.
This verification procedure is carried out for the security of the Customer and, therefore, by accepting these General Conditions of Purchase, the Customer agrees to submit to the procedure for detecting possible fraudulent transactions referred to and authorizes YOUREMTB so that, once the Customer provides the information and additional documents referred to, they can be used for future purchases of the same Customer.
Delivery of products
Once YOUREMTB has verified that the purchase process has been completed correctly, it will proceed to deliver the products to the address indicated by the Customer in the purchase procedure, during normal working hours and within the deadlines set out in the Website/App that, in no case, will be later than thirty (30) days following the Customer's acceptance of the order.
YOUREMTB may inform the Customer, by sending an email, the date of departure of the order from YOUREMTB's warehouse and the contact details of the transport company that will make the delivery.
Delivery shall be made within 72 working hours and shall be deemed to have taken place from the moment the product has been made available to the Customer at the place indicated by the Customer or at the corresponding collection point.
The risk of the products (including, but not limited to, loss, damage or theft) shall pass to the Customer from the time the products are made available to the Customer.
If there were any incident in the delivery of the products, YOUREMTB would inform the Customer immediately and appropriately.
Delivery may be made by any of the following methods:
- To the address indicated by the Customer at the time of purchase.
In the event that the Customer, after making the purchase, would like to change the delivery address may do so provided that the order is "Pending Shipment". YOUREMTB not be liable for errors and / or damage caused in the delivery when the address entered by the Customer does not exist, is incorrect or when the requirements for the change of delivery address indicated above are not met. YOUREMTB may deliver the products in several shipments.
If at the time of delivery of the product at the address provided by the Customer, he/she is absent or no one picks up the product, the Customer must contact YOUREMTB as soon as possible to arrange a new delivery date. If the delivery of the product to the Customer has not been made for reasons not attributable to YOUREMTB or the carrier, the products will be returned to YOUREMTB and the Customer must assume the costs of shipping and return, as well as any associated management costs.
- Shipping costs.
Shipping costs will be free for orders over 89€.
Withdrawal
The Customer has a period of fourteen (14) calendar days from the date of receipt of the product to exercise their right of withdrawal at no cost to the Customer.
Notwithstanding the foregoing, the Customer may not withdraw in the following cases:
a) Products made to the Customer's specifications or clearly personalized.
(b) sealed products which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.
To exercise the right of withdrawal, the Customer must complete the Withdrawal Form and send the product to be returned together with the instructions, documents and packaging. If the good is not delivered in its original packaging or wrapping the good could suffer a depreciation.
Once the right of withdrawal has been properly exercised and, in any case, within a maximum period of fourteen (14) calendar days until receipt of the goods or until the consumer provides proof of return of the goods, such as the receipt from the transport company. YOUREMTB will credit the invoice originally issued and refund the Customer the full amount of the purchase and delivery charges.
Below, we provide the model withdrawal form. Please note that the following form should only be completed and submitted if the Customer wishes to withdraw from the contract. I hereby inform you that I withdraw from my contract of sale of the following good(s):

Return
Without prejudice to the right of withdrawal provided above, you will have 365 days from receipt of the order to make a return (or size change). To process it you must access the section My account > My orders > Select order > Return or Size Change, indicate the reason for the return, select the products to be returned and confirm the process. You will then receive a delivery note by email that you must print and insert inside the box. If you have problems with any step, you can contact Customer Service (administracion@youremtb.com).
In case of return from the Canary Islands or other non-EU parts of the world, the customs declaration (CN22 and/or CN23) must also be indicated on the outside of the package. Failure to do so may result in the goods being rejected by customs and returned to the sender.
Before returning an order, please be sure to contact the tax authorities in your country to confirm whether import duties will be refunded.
For the return, you can use the same box or envelope in which the product has been sent, or failing that in a similar format that guarantees the perfect condition of the product during shipment.
The right of return is subject to the following conditions:
- The products must be in the same condition as you received them, unused, in their box, packaging, with their original labels and undamaged.
- Items with specific expiration dates (such as nutrition products) are exempt from the 365-day return policy.
- The product return option does not apply to gift cards.
Once received, YOUREMTB will check the suitability of the item in its warehouse, and reserves the right not to make the refund if it detects that the purchased product and the returned product do not match or that the return has not been made in accordance with these Terms and Conditions of Purchase.
The cost of the return shall be borne by the Customer except in those cases where the product is defective. When shipping, it is advisable to use a shipping method that includes delivery confirmation. As soon as YOUREMTB receives the return in its warehouses, it will check that the product is correct and will process the corresponding payment. This process can take up to 14 calendar days and, if everything is correct, will proceed to the payment of the returned product through the payment system used within forty-eight (48) hours from the confirmation of arrival at the warehouse of the order.
The application period for the refund of the amount will be up to seven (7) calendar days for debit cards and up to thirty (30) calendar days for credit cards. In case of having made the payment by bank transfer it will be necessary to provide an account number where to pay the amount to be refunded and it may take two (2) business days to be reflected in the recipient bank.
Partial returns of an order will result in the reimbursement of the price of the Product returned, but not the shipping costs.
To return a bicycle or other bulky goods, please contact our Customer Service team or see the relevant section.
When making a return, the only option available is to send the items to the return address indicated.
In the case of the return of defective products, the Customer shall be entitled to reimbursement of the price, shipping costs and return transport costs of the defective products or of the products delivered if they do not correspond to the order placed by the Customer, in accordance with the applicable legislation.
Complaints and claims
The Customer must contact YOUREMTB, through the means indicated at the beginning of the General Conditions of Purchase, to express their complaints and claims, committing YOUREMTB to address them as soon as possible and, in any case, within one month after they are submitted.
Warranties
The warranty of the products sold through the Website/App will be in accordance with the provisions of current legislation and, therefore, in general, YOUREMTB will respond to the lack of conformity manifested by the Customer within two (3) years from the delivery of the products. In the absence of proof to the contrary, it shall be presumed that any lack of conformity that becomes apparent within two years of delivery of the goods already existed when the goods were delivered.
Specifically, if the product sold by YOUREMTB is not compliant, the Customer may choose between repair or replacement of the product (unless one of these options is impossible or disproportionate) or, alternatively, between a price reduction or termination of the contractual relationship in accordance with current legislation. In any case, the Customer must inform YOUREMTB of the lack of conformity within a maximum period of two (2) months after becoming aware of it. YOUREMTB will assume the cost of returning the products in such cases.
Notwithstanding the foregoing, the products shall be deemed to be in conformity and, therefore, shall be out of warranty when:
a) The damage or deterioration in the products sold by YOUREMTB occurs for reasons beyond the control of the manufacturer or YOUREMTB or, where appropriate, who acts under its responsibility (force majeure, accident, etc.) or as a result of incorrect configuration and / or installation of the product by the Customer; and
b) Damage or deterioration in the products sold is caused or originated by a component that was not supplied by the manufacturer or YOUREMTB or is the result of alterations or repairs carried out by persons other than the manufacturer or YOUREMTB or, where appropriate, by those who act under their responsibility.
Online Dispute Resolution
In accordance with art. 14 of Regulation 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution in consumer matters, YOUREMTB informs Customers that they can submit their complaints to the dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr
Language
The General Conditions of Purchase are written in English.
Applicable law and jurisdiction
The General Conditions of Purchase shall be governed by and construed in accordance with Spanish law.
In the event of any conflict or discrepancy arising in the interpretation and/or application of the General Conditions, the competent Courts will be those provided for in the applicable regulations regarding the competent jurisdiction of consumers and users.
2. CONDITIONS OF THE LEASING SERVICE: SPECIFIC ASPECTS OF LEASING CONTRACTS
The clients/users/lessees of YOUREBIKE S.L.U. when contracting with the company, agree with all of the following clauses:
- The contracting with YOUREBIKE S.L.U. can be done in two ways:
- Electronic/online contracting with delivery of the battery, bicycle or selected goods or products to your specific address.
- In-person contracting with collection of the battery, bicycle, goods or products chosen in the shop or establishment of YOUREBIKE S.L.U., located at Calle Urano 50 Tresa Cantos Madrid 28760.t
- In any of the two previous modalities, the client/user/lessee accepts all the Terms and Conditions of the contract here reflected.
- In any of the two previous modalities, in order to reserve any of the products offered, it will be compulsory for the client/user/lessee:
- Online mode:
- The express acceptance of all the present general contracting conditions.
- The identification of your identity through the legal identification platform provided by YOUREBIKE S.L.U., being the same GDPR Compliance. In this sense, the customer / user / tenant expressly accepts and agrees to the exposure of your ID for the sole purpose of proving your identity, as well as for the collection of basic data from your customer account. All this in accordance with the provisions of the privacy policy YOUREBIKE SLU.
- Selection of the period of time for which you intend to make the reservation.
- Make the payment.
- Face-to-face mode:
- The express acceptance of all these general conditions of contract by signing the contract on paper that will be provided in the store.
- The identification of your identity through your ID card, which will be scanned for the sole purpose of such accreditation, as well as for the collection of the basic data of your customer account. All this in accordance with the provisions of the privacy policy YOUREBIKE SLU.
- Selection of the period of time for which you intend to make the reservation.
- Make the payment.
- Online mode:
- The signature of the contract and/or the acceptance of the General Conditions of Contract will be totally obligatory in order to receive or withdraw the bicycles, batteries or any other contracted goods.
- The rental will have the duration established in the reservation and in the contract.
- The battery, bicycle, goods or products must be returned on the date and at the place specified in the contract.
- YOUREBIKE S.L.U. may unilaterally terminate the contract before the date of its conclusion in case of serious breach by the lessee in the use and care of the battery, bicycle, goods or products.
In this case, YOUREBIKE S.L.U. may take immediate possession of the battery, bicycle, goods or products in the place where they are located, without the customer being entitled to any claim or compensation.
- Shipping costs are not included in the price of batteries, bicycles, goods or products offered on the Web. When the user selects any of the products the shipping costs are indicated. The definitive shipping costs will appear for its express acceptance on the part of the user before finalizing the process of renting and once the user has facilitated the direction of shipment of the product.
Failure to comply with the delivery time will result in an additional cost to the tenant of 12 euros per hour or fraction thereof.
If the batteries, bicycles, goods or products rented are delivered before the end of the contracted rental period, there will be no refund of the amount proportional to the remaining time.
- Payment will be made on the day of booking the rental of batteries, bicycles, goods or products, either online or in person. It will be made for 100% of the amount by credit card, cash, or by any of the means established in clause 10 of these conditions.
- The deposit, or deposit, for the reservation of batteries, bicycles, goods or products will be the corresponding to 150 € or 300 € depending on the product purchased. The specific amount will always be calculated and established before the customer / user / tenant makes the purchase, accumulating and breaking it down to the final payment. YOUREBIKE S.L.U. will always inform the client/user/lessee of the exact amount that will be charged prior to making the payment.
The payment of the rental fee and the deposit will always be made in full and in advance at the time of formalizing the lease.
This deposit or deposit will be intended to cover possible flaws, losses or damages in any of the rented products, as well as the accessories that have been rented. In the event that the same becomes insufficient to cover such damage.
The payment of this deposit or deposit shall be made by any of the means established in clause 10 of these conditions:
- In the case of contracting the service in the face-to-face mode: you must pay the deposit together with the total amount of the service.
- In the case of hiring the service in the online mode: the amount of the deposit will be retained in your account during the period for which the lease of the goods or services lasts.
By accepting these General Conditions, the client/user/lessee expressly authorises YOUREBIKE S.L.U. to automatically collect the deposit, for which it may use the details of the bank card provided by the client/user/lessee at the time of booking.
Once YOUREBIKE S.L.U. has checked the condition of the goods after the rental or use by the client/user/lessee, if the conditions of return are met (same condition in which the goods were rented), the deposit will be refunded.
- Subscriptions and subscribers: YOUREBIKE S.L.U. establishes a subscription service, which will consist of the following:
The customer/user/tenant may subscribe to the service offered in exchange for a fixed monthly fee that will be established at the time of purchase. The subscribed customer/user/tenant will immediately obtain a series of advantages and particularities of the service described below:
- Shipping and collection of batteries, bicycles, goods or rented products free of charge as long as it is within the Community of Madrid.
- Possibility of acquiring the lease for a minimum period of 1 day.
- In the case of a bicycle, it will be delivered adjusted to the measurements and weight of the rider.
The subscription will continue until its conclusion, which may be cancelled both by the customer/user/lessee and by YOUREBIKE S.L.U. itself with sufficient notice.
The subscription can be cancelled at any time. The client/user/tenant will continue to have access to the service until the end of the billing period. Payments are non-refundable and YOUREBIKE S.L.U. will not provide refunds or credits for partial subscription periods.
To cancel the subscription, go to the "XXXXXXXXXXXXXXXX" page and follow the cancellation instructions. When the subscription is cancelled, the account will be automatically closed at the end of the current billing period.
Unless the customer/user/lessee cancels their subscription prior to the billing date, they expressly authorise YOUREBIKE S.L.U. to charge the subscription fee corresponding to the next billing cycle. The length of the billing cycle will be, in any case, one month.
YOUREBIKE S.L.U. may change the subscription plans and their price at any time. However, no change in price or subscription plans already contracted will come into force within 30 days of notification by YOUREBIKE S.L.U.
From time to time, there may be a variety of subscription plans, including subscriptions offered by a third party in combination with the provision of its own products and services. Some subscription plans may have different terms and limitations, which will be disclosed at the time of registration and contracting, or in other communications that will be available.
Specific details about the subscription to the platform can be found by visiting the YOUREBIKE S.L.U. website and clicking on the "XXXXXX" link available at the top of the page, under the profile name.
- Cancellations: The client/user/lessee may cancel the reservation, being entitled to a refund of the amounts paid, but deducting the amounts indicated below:
- Cancellation at least 72 hours before the actual day of rental: 100% refund of the amount of the booking confirmation.
- Cancellation between 24 and 72 hours before the actual day of rental: 80% refund of the amount of the booking confirmation.
- Cancellation less than 24 hours before the actual day of rental: penalty of 100% of the amount of confirmation of the reservation, without being able to be exchanged or changed for other dates.
- Only in the case of bike rental will be included in the price the helmet, air pump, water bottle holder and security lock. All equipment, including the bike, will be returned complete and in the same condition in which it was delivered to the customer / user / tenant.
- In the case of rental of batteries for electric bicycles, they will be delivered at 100% capacity, guaranteeing YOUREBIKE S.L.U. the full performance of the unit in terms of autonomy and operation.
- The customer/user/lessee is obliged to take good care and take all necessary precautions to protect the rented batteries, bicycles, goods or products from damage, loss, theft or robbery. Should any of the aforementioned situations occur during the rental period due to wilful misconduct, negligence or causes attributable to the customer/user/lessee, the customer/user/lessee shall immediately assume all replacement costs incurred at the rate or, failing that, at the market price.
- The customer/user/lessee must inform YOUREBIKE S.L.U. of any damage caused to the batteries, bicycles, goods or products rented or the malfunction of the same.
At the end of the rental period, YOUREBIKE S.L.U. will determine the conditions of delivery of the rented equipment and will assess, if necessary, the losses, damage caused or the state of cleanliness.
- The client/user/lessee declares to be in perfect health, to be able to handle a bicycle and to have the necessary control of the rented equipment and undertakes to respect the laws and traffic regulations in force, as well as to be responsible for any damage caused as a result of any accident during the use of the bicycle. Likewise, YOUREBIKE S.L.U. is not responsible for any fine or penalty resulting from any infringement of these laws by the customer / user / lessee.
- The client/user/tenant is aware that it is compulsory to wear a helmet on intercity roads, except for minors, who must wear it both in the city and on intercity roads. YOUREBIKE S.L.U. always recommends the use of helmets to prevent or minimise possible accidents. The customer will be responsible for any penalty or damage caused by NOT using a helmet with our bicycles.
- The client/user/lessee is aware of the risks involved in riding a bicycle and is solely responsible for any damage caused to himself, to third parties or to any property, movable or immovable, by the use or normal or abnormal use of bicycles.
YOUREBIKE S.L.U. is not liable for claims for bodily injury or property damage caused to himself or third parties by the user or objects owned by the user, for causes attributable to him or third parties.
- The client/user/lessee may not assign, sublet, sell, mortgage, exchange or pledge the batteries, bicycles, goods or products rented under this contract, unless he/she has the prior written consent of YOUREBIKE S.L.U.
Failure to comply with this obligation will be cause for termination of this contract, as well as YOUREBIKE S.L.U. may claim for damages.
The customer/user/lessee shall use the rented batteries, bicycles, goods or products for personal transport, exclusively, without profit and within the normal capacity of the same and, in the case of bicycles or batteries for bicycles, shall drive it personally.
- Minors under 18 years of age must be accompanied at all times by an adult who is responsible for the correct use of the batteries, bicycles, goods or products rented, as well as the rest of the material.
- This contract is subject to Spanish law. In case of any conflict or discrepancy, the applicable jurisdiction shall be the Courts or Tribunals of the Customer's domicile, unless the Customer is a professional, in which case it shall be subject to the jurisdiction corresponding to the registered office of Yourebike SL.
Shipping and cancellation policy
The following conditions and criteria shall apply with regard to shipments and delivery times:
- In the event that the customer/user/lessee makes use of the online mode of purchase or lease of batteries, bicycles, goods or rented products:
- They must be requested at least 72 hours in advance to guarantee delivery by YOUREBIKE S.L.U..
- A reservation period shorter than the above can only be requested by subscribers to the service, or opt for collection at YOUREBIKE S.L.U. facilities.
- In the event that the customer/user/lessee makes use of the face-to-face mode of purchase or lease of batteries, bicycles, goods or rented products:
- There will be no limit on how far in advance the reservation can be made, but it will be subject to the existence of stock of batteries, bicycles, goods or products to be rented.
- The batteries, bicycles, goods or products rented will be delivered by YOUREBIKE S.L.U. on the day reserved by the client at the address indicated in an indicative schedule that, in no case will be later than 20:00 hours of the corresponding day. YOUREBIKE S.L.U. will make every effort to deliver the rented goods prior to the day of the reservation, without this early delivery deriving or implying any extraordinary cost for the client/user/lessee.
- The collection of the batteries, bicycles, goods or products rented by YOUREBIKE S.L.U. will take place on the same day as the end of the period reserved by the client/user/lessee, in the same place of delivery, after the hours corresponding to the reserved days computed from the receipt of the material by the client or its availability in the corresponding place.
Under no circumstances will deliveries or collections take place on Sundays. If the rental period ends on that day, collection will take place on the day immediately following before 9:00 am.
- In the event that batteries, bicycles, goods or rented products are delivered and collected at YOUREBIKE S.L.U. premises, this will be done within YOUREBIKE S.L.U. business hours, from 10 am to 12 noon and from 4 pm to 6 pm from Monday to Friday.
- If the batteries, bicycles, goods or rented products arrive earlier than expected by YOUREBIKE S.L.U. or than requested by the user/client/lessee, no additional charges will be made, so that the latter can enjoy the days reserved, as well as the advance period.
- In the exceptional case that the batteries, bicycles, goods or rented products do not arrive on the agreed date for reasons beyond the control and not attributable to the user/customer/lessee, the latter may choose between:
- Enjoy in compensation an additional day corresponding to the day immediately following the end of the rental, or,
- The credit or refund of the corresponding day.
- In the cases in which, having attempted delivery, the user/customer/lessee is not available at the address indicated, notice will be left to the user/customer/lessee, who may choose to do the following:
- Request again the delivery at the same or another address, bearing all the shipping costs incurred.
- Collect, if possible, the goods at YOUREBIKE S.LU. facilities or at the address indicated by the latter.
- Cancel the reservation with the conditions set out in section 8.11 of these conditions.
- In the case of returning batteries or bicycles, they will not be washed under any circumstances, as this could damage the electrical system. The return will be made in any case in the state in which it would have been after use. Under no circumstances should they be washed with pressurised water. If damage is caused to batteries or bicycles as a result of failure to comply with the provisions of this section, will be the sole and exclusive responsibility of the user / customer / tenant, having to meet the costs and expenses that may entail the repair or replacement of the property.
Methods of payment and price
The prices established for bicycles and other products on the date on which the order is placed will be applicable. The established prices are clearly stated on the Website, so that the user is aware of the final (total) prices, i.e. they include value added tax in Spain at the applicable legal tax rate, as well as the method of payment at the time of contracting.
Shipping costs will depend on the shipping address and the weight of the order, in accordance with the above clause.
YOUREBIKE S.L.U. has several ways to accept payment of orders. Each one with very high security standards to ensure payment with confidence, being the following:
- Cash
- Credit Card
Credit Card
You can use any type of Visa, MasterCard, Maestro and American Express card. Visa, MasterCard and American Express have developed a system to securely make payments on the Internet. With the Secure Electronic Commerce system, the card issuer (bank or savings bank) identifies the cardholder before authorizing the payment.
YOUREBIKE S.L.U. and this website adheres to this security protocol. Therefore, once you have selected the products to buy and entered your card number, a window opens where the Issuer requests the identification of the cardholder. These security systems are Verified by VISA and MasterCard Secure Code. Your card details and password are protected by this system from the moment they are entered.
Once the identification has been completed, the Issuer informs YOUREBIKE S.L.U. that the cardholder is making the purchase so that the process can be completed. If the identification has not been satisfactory, the Issuer informs YOUREBIKE S.L.U. to proceed accordingly.
For payments made with cards issued outside Spain, the issuing bank must be a member of the Secure Electronic Commerce Security Protocol. Payments with cards that do not comply with this requirement will not be authorized.
YOUREBIKE S.L.U. reserves the right to delay the management of suspicious orders and refuse any transaction made by credit card. In this case we will proceed to refund the amount on the original card.

Right of withdrawal
When contracting and acquiring goods and services from YOUREBIKE S.L.U. on its YOUREMTB platform, you have a legal right of withdrawal.
Without prejudice to what is established for cancellations in section 8.11 of these conditions, YOUREBIKE S.L.U. establishes two limited cancellation options:
- If the user or customer finds the problem after the delivery of the order, should write an email to aadministracion@youremtb.com or call 911381211.
You can also complete and submit the withdrawal form or other unequivocal declaration online using the contact form on this website, and send it to the same web address as above. We will then send an acknowledgement of receipt without undue delay.
Your money will be refunded within 14 days.
The return shipping costs are borne by the customer as long as this return is attributable to the customer and vice versa. If the return is originated by a bad condition of the product or, it will be ordered to be picked up at home without any cost to the user / customer / tenant.

7. WASTE MANAGEMENT.
Waste management of batteries, accumulators and battery packs
What are batteries and accumulators?
Batteries and accumulators are devices that enable electrical energy to be obtained by transforming chemical energy. Batteries and accumulators are used in transistors, toys, flashlights, watches, calculators, cameras, cell phones, etc. Batteries and accumulators contain some heavy metals such as mercury, cadmium or lead, which are potentially hazardous to health and the environment. They are therefore considered hazardous waste and are subject to specific collection and treatment.
Within these concepts, a distinction must be made between a battery, consisting of one or more primary elements (these cannot be regenerated and are therefore not rechargeable) and an accumulator, consisting of one or more secondary elements (these can be regenerated and are therefore rechargeable). That is to say, once the accumulator is exhausted we can regenerate the active elements, therefore, its life can contemplate several cycles of charge and discharge, something that does not happen with the battery.
Some accumulators are commonly referred to as batteries, such as cell phone batteries, but this name does not fit the definition of battery established in the European and Spanish regulations governing this waste, while automotive and industrial batteries are included in this definition.
This type of waste, due to its characteristics and proliferation, is governed by specific regulations at European level, Directive 2006/66/EC, which has been transposed into the national regulatory framework by Royal Decree 106/2008, of 1 February, on batteries and accumulators and the environmental management of their waste, and Royal Decree 943/2010, of 23 July, which amends Royal Decree 106/2008. These regulations incorporate the "polluter pays" and producer responsibility principles, so that producers, who place this product on the market for the first time, such as manufacturers, importers or intra-Community purchasers, are obliged to take responsibility for the collection and management of the same quantity, in terms of weight and type, of the batteries and accumulators they have placed on the market.
The regulation affects all types of batteries, accumulators and battery packs, regardless of their shape, volume, weight, composition or use:
- Button cells
- Standard batteries
- Portable accumulators
- Batteries, accumulators and automotive batteries
- Cells, accumulators and industrial batteries
- Other types
It also includes cells, accumulators and batteries from end-of-life vehicles and electrical and electronic equipment. The only exceptions are batteries, accumulators and battery packs used in equipment designed for military purposes or intended to be sent into space, which are excluded from these regulations.

Obligations and rights of consumers
- Consumers have a legal obligation to return batteries at the end of their useful life.
- The ecological commitment not to abandon hazardous batteries and accumulators in unsorted urban waste streams.
- The possibility of delivering batteries and accumulators once they have been used at the point of sale of the producers/distributors.

Before depositing the device in the collection facilities, the end user must remove the batteries and accumulators from the device and deposit them in the selective collection points for this waste, provided that the intervention of a qualified professional is not necessary for this purpose.
Waste Electrical and Electronic Equipment (WEEE) Management
Introduction to the legal regime for electrical and electronic equipment
Royal Decree 110/2015, of February 20, on waste electrical and electronic equipment.
The legal regime for electrical and electronic equipment (EEE) and its waste (WEEE) was established at Community level through Directive 2002/95/EC of the European Parliament and the Council, of January 27, 2003 on the restriction of the use of certain hazardous substances in EEE (ROHS Directive1) and Directive 2002/96/EC of the European Parliament and the Council, of January 27, 2003, on waste electrical and electronic equipment (WEEE Directive1). Both directives were transposed into Spanish law through Royal Decree 208/2005, of February 25, 2005, on electrical and electronic equipment and the management of its waste.
In spite of this European regulation, WEEE has continued to increase as a consequence of its ever shorter innovation and replacement cycles, which have turned EEE into a growing source of waste. WEEE contains hazardous components that generate an important problem during its management and, in some cases, this management has not achieved adequate recycling rates. This situation is compounded by the significant outflow of WEEE outside the European Union in an uncontrolled manner and the lack of knowledge of the final management of this waste, with the risk of affecting human health and the environment in the destination territories, as well as the consequent loss for the Union of components with a high economic value.
As a result, both directives were revised and eventually replaced by two new directives:
- Directive 2011/65/EU of the European Parliament and of the Council of June 8, 2011, on the restriction of the use of certain hazardous substances in EEE (ROHS Directive2), aimed at prevention, which was transposed into Spanish law by Royal Decree 219/2013 of March 22, 2013, on the restriction of the use of certain hazardous substances in electrical and electronic equipment.
- Directive 2012/19/EU of the European Parliament and of the Council of 4 July 2012 on waste electrical and electronic equipment (WEEE Directive2), oriented towards the management of WEEE and incorporated into national legislation through Royal Decree 110/2015 of 20 February on waste of electrical and electronic equipment. Spanish legislation on waste of electric and electronic equipments (WEEE): Royal Decree 110/2015 of 20 february.
The 2012 Directive (WEEE2) incorporates the most updated principles of Community legislation in this area, especially the principles of Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives (the so-called "Waste Framework Directive"). This directive includes the approaches of efficient use of resources, prevention and progress towards the decoupling of economic growth and the increase in waste generation, as well as the principle of waste management hierarchy.
Directive 2012/19/EU (WEEE2) aims to:
- Contribute to sustainable production and consumption by promoting, as a priority, the prevention of WEEE generation and the promotion of preparation for reuse. The directive establishes that it is especially important to advance in a type of design and production of EEE that facilitates the repair of these products, their reuse, disassembly and recycling.
- Make a more efficient use of resources, reinforcing recycling and taking into account that the recovery of critical raw materials contained in waste from this sector is particularly relevant.
- To improve the environmental behavior of EEE producers, distributors and consumers, and in particular, of those agents directly involved in the collection and treatment of WEEE.
Other noteworthy aspects of the Directive are:
- The obligation for Member States to increase the separate collection of WEEE in a progressive manner and according to the products placed on the market. From 2016, the minimum collection rate to be achieved will be 45% of the average weight of EEE placed on the market in the Member State concerned in the previous three years. The minimum annual target will be increased to reach, by 2019, 65% of the average weight of EEE placed on the market in the previous three years or, alternatively, 85% of the WEEE generated in the territory of that Member State. The Directive directly involves Local Authorities, distributors, EEE producers, through their own collection networks, and waste managers in the separate collection of WEEE.
- Maintaining the application of the principle of extended producer responsibility so that the manufacturer of electrical equipment is obliged to assume the financing of the management of waste from its equipment.
- The obligation for Member States to account for the collection of WEEE through all authorized collection channels: clean points, distributors, return systems set up directly by manufacturers or collection by authorized waste managers. Each Member State will have to establish its own waste accounting tools to ensure the reliability of the data and the traceability of the collected waste.
- The grouping of electrical and electronic equipment into 6 categories instead of 10.
